Abstract

The activity of loading and unloading dangerous cargoes of diesel fuel in the waters of ports in Indonesia, without notifying or not having a permit for loading and unloading dangerous cargo from the harbormaster, is a form of violation of the provisions in Article 322 jo. Article 216 paragraph (1) of Law no. 17 of 2008 concerning Shipping. In this study, the author discusses: 1) How is the system for managing dangerous cargo loading permit documents at the harbormaster's office and the Port Authority?, 2) How is the conception of law enforcement for loading and unloading dangerous goods for diesel fuel in port waters without the harbormaster's approval?, 3) What are the consequences of this action? Is it against the law for the captain of the ship to carry out loading and unloading activities for diesel fuel dangerous goods in port waters without having a permit for loading and unloading dangerous goods? This research aims to provide an explanation of the management of permit documents to unload dangerous cargo through the existing system in the Syahbandar office and the Port Authority, the conception of law enforcement for loading and unloading dangerous goods for diesel fuel in port waters without the harbormaster's approval, and the legal consequences for ship masters who carry out loading and unloading activities. dangerous goods for diesel fuel in port waters without having a loading and unloading permit for dangerous goods. This research uses a normative juridical approach by presenting qualitative data analysis. The captain of a ship carrying out loading and unloading activities for diesel fuel dangerous goods in port waters, without having a loading and unloading permit for dangerous goods, is an act that violates the law and can be subject to sanctions, as stated in the decision of the Tanjungpinang District Court No. 159/Pid.Sus/2020/PN Tgg, is clearly a special criminal act and has been sentenced to imprisonment and a fine.
